It is a condition of CNPS assistance that the legal matter requiring assistance arise from nursing care. CNPS assistance does not generally extend to business advice. In the context of regulatory investigations, the CNPS recognizes that the vast majority of complaints relate to a beneficiary’s personal nursing practice, whether nursing services are provided as an independent practitioner, on behalf of an employer, or within a business providing professional nursing services.
However, as complaints before the regulatory body could arise from commercial decisions in the context of the management of a business, the CNPS Board of Directors has determined that CNPS assistance under the Supplementary Protection program does not extend to complaints or investigations pertaining to decisions or alleged decisions relating solely to commercial or employment matters made by a beneficiary as an employer of others, or as a proprietor or operator of a business. Complaints of this nature may include, for example, those involving trademark disputes or allegations of inappropriate competition activities.
Registrants of the Supplementary Protection program remain eligible for assistance with regulatory investigations arising from nursing practice, as described above.
